INDEPENDENT TRAVEL ADVISOR SERVICE AGREEMENT   

This Agreement is made between Sunshine Travelers Experiences (“Agency”) and the undersigned Independent Travel Advisor (“Advisor”).

 

1. TERM   

This Agreement begins on the Effective/Purchase Date and remains in effect until terminated by either party with written notice (see Section 9).

 

2. INDEPENDENT CONTRACTOR RELATIONSHIP   

The Advisor is an independent contractor and not an employee, partner, or legal representative of the Agency. The Advisor is solely responsible for their business expenses, taxes, and legal obligations.

 

3. SCOPE OF SERVICES   

The Advisor will provide travel planning, booking, and customer support services for individual and group travel. The Advisor agrees to:

 • Represent the Agency in a professional and ethical manner.

 • Use approved platforms and tools provided by the Agency.

 • Follow all industry and Agency-specific policies and procedures.

 

4. COMMISSIONS & PAYMENTS   

 • Advisors will receive 75% of the net commission earned on bookings.  Agents will receive 100% of any additional planning fees they charge the client through TravelJoy minus any credit or debit card processing fees.

 • Commissions after the client has traveled, the agent has submitted the commission for payment and the supplier has paid the Agency.

 • A minimum of $10,000 in total sales per calendar year is required to continue to be eligible for an individual CLIA card. This requirement may be waived during the first year.

 

5. FEES & TECHNOLOGY ACCESS   

 • Advisor agrees to pay an annual service fee of $279 (or $39 monthly) for access to booking platforms, TravelJoy CRM system, Travel Advisor Community for questions and training, and Errors & Omissions Insurance. This amount is subject to change upon renewal at any time. 

 

6. CLIENT OWNERSHIP   

Clients booked under the Advisor’s name are considered clients of the Agency if the Agency provided the lead to the Advisor. The Advisor may take their client list with them only if mutually agreed upon in writing and all outstanding commissions or balances are settled.

 

7. CONFIDENTIALITY & NON-DISCLOSURE   

The Advisor agrees to keep confidential any client data, supplier agreements, pricing structures, marketing strategies, and other proprietary information belonging to the Agency.

 

8. BRAND USAGE   

The Advisor may use the Agency’s branding and logos only as approved. The Advisor may not represent themselves as the owner of the Agency or create independent websites/social media using the Agency’s name without permission.

 

9. TERMINATION   

This Agreement may be terminated:

 • By either party with 30 days’ written notice.

 • Immediately by the Agency for breach of contract, misconduct, or unethical behavior.

Upon termination, all bookings and commissions in process remain the property of the Agency.

 

10. LIABILITY   

The Advisor agrees to indemnify and hold harmless the Agency against claims arising from their negligence, misinformation, or breach of terms.

 

11. GOVERNING LAW   

This Agreement shall be governed by the laws of the State of Florida without regard to its conflict of law provisions.

 

12. SELLER OF TRAVEL COMPLIANCE   

Advisors residing in Florida, California, Washington State and Hawaii are individually responsible for complying with their state’s Seller of Travel laws and must register as a Seller of Travel if required by state law. Sunshine Travelers Experiences is not liable for any failure of the Advisor to comply with these legal requirements.

The Advisor agrees to:

  •   Determine whether they are required to register based on their state of residence and business operations.
  •   Complete the necessary registration and renewals, and pay all associated fees.
  •   Provide proof of registration to the Agency upon request.

Failure to comply with applicable Seller of Travel laws may result in immediate termination of this agreement. 

 

13. NON-SOLICITATION OF OTHER ADVISORS  

In the event the Advisor chooses to leave Sunshine Travelers Experiences, they agree not to recruit, solicit, or attempt to persuade any other current Sunshine Travelers Experiences Advisors to leave the Agency or join another agency for one (1) year from the date of departure.

 

This includes, but is not limited to:

 • Direct outreach (email, text, social media, phone)

 • Indirect efforts through referrals or intermediaries

 • Posting or promoting competitive opportunities in Agency-affiliated communities or groups

 

Violation of this clause may result in legal action and forfeiture of any outstanding commissions.

 

14. ENTIRE AGREEMENT   

This document constitutes the entire agreement between the parties and supersedes all previous communications.
